Donald Trump declared an emergency at the border. The national emergency allowed him to divert over $3 billion to build 150 miles of border wall. A court suit was filed to stop the construction. The Texas cocourt stopped the construction, but the Fifth Circuit Court of Appeals (with one Trump and one Reagan appointee) said Trump can use the funds to build the wall.
The Wall Street Journal reports:
The Wall Street Journal: The Fifth Circuit’s order allowing the Trump administration to proceed came in a brief 2-1 decision, with appointees of Presidents Reagan and Trump in the majority, and an Obama appointee in dissent. The order wasn’t a final ruling on the merits of the case, but gives the administration a green light for now.
The court’s majority cited a Supreme Court order from July that allowed the Trump administration to move ahead with related plans to use military funds for border barrier construction.
The majority also said the plaintiffs suing the Trump administration, the county of El Paso, Texas, and the advocacy group Border Network for Human Rights, likely lacked standing to bring a lawsuit. The Wall Street Journal
Here is the key to the ruling-the plaintiffs lacked standing to bring the suit. Without standing, a person or entity is unable to enforce legal rights in a court. If a party does not have standing, it usually means that party cannot gain the relief it seeks.
We cannot say that if a party with standing would win this case. However, the lack of standing meant that this case is lost unless reversed by the Supreme Court of The United States.
